E-Commerce and Communications: Transactions in Digital Information is an analytical treatise covering the rapidly changing fields of electronic commerce and communications, focusing on the collision of intellectual property, commercial and communications law in cyberspace. Discussions include challenges to traditional trademarked identity by domain names and hyperlinks and the rush to seek Internet business method patents, and on new statutory frameworks such as the Uniform Computer Information Transactions Act (UCITA) and the Uniform Electronic Transactions Act (UETA). UCITA currently covers all "computer information transactions," which include contracts for live feed of stock quotations and, a fortiori, contracts for empirical research requiring collection of data in digital form. UCITA and UETA are expected to provide a framework for on-line commerce generally. The statutory provisions of these two acts are discussed in detail, with the text of each statute reprinted in the section in which it is discussed.
The treatise will provide an introduction to current "hot issues," such as "Cybersquatting" and privacy on the Internet. It analyzes issues of ownership of information on an open network, including issues raised by the rapid rise of "MP3" digital distribution of music.
